Wrong. Texas law provides MANDATORY penalty damages against insurance companies and TWIA for not timely paying your claims. They have about 60 days to pay you from the date you provide them all the information they need to evaluate the claim. If they do not pay you in time they are required to pay you 18% interest on those damages. Texas law also provides for 6% pre-judgment interest. So, for example, if the carrier or TWIA failed to pay you $15,000.00 for your roof, they now owe you $15,000.00 plus $3,600 (24% interest on $15,000.00) plus attorney fees. If you can prove that the insurance company acted knowingly then you can receive up to three (3) times your actual damages under the Texas Deceptive Trade Practices Act.
